आपको लग रहा है कि Advocate ने नया legal route खोज लिया है… लेकिन अगर Court को पुराने Case की जानकारी ही नहीं दी गई हो तो?
This is where a simple question can become extremely serious:
“क्या आपके खिलाफ इसी matter में पहले भी कोई case, petition, revision या dismissal order हो चुका है?”
Most clients may not know every procedural detail.
They trust the lawyer.
They hand over the old papers.
They explain the history.
फिर नया petition तैयार होता है — और client मान लेता है कि Advocate ने पूरा record check कर लिया होगा.
But a recent Delhi High Court judgment shows why that assumption can be dangerous.
In Harjeet Singh Mendiratta v. State Govt. of NCT of Delhi & Anr., W.P.(CRL) 3144/2024, judgment dated 14 August 2026, the Court examined a fresh quashing petition where an earlier petition seeking essentially the same relief had already been filed in 2012 and dismissed.
The later petition contained a positive declaration stating that no similar petition had previously been filed.
The High Court found that the earlier proceeding and its dismissal had not been disclosed when the fresh petition was filed. The Court noted that the filing advocate had personal knowledge of the litigation history and held that the conduct could not be treated merely as an inadvertent omission on the facts before it.
Now pause.
पुराना case छिपना एक बात है.
लेकिन Court pleading में “ऐसा कोई previous case file नहीं हुआ” लिख देना दूसरी बात है.
That difference can matter enormously.
The Delhi High Court held that an advocate appearing before a Constitutional Court has obligations not only towards the client but also as an officer of the Court, including making full, fair and accurate disclosure of material facts.
The Court also referred to the professional standards requiring advocates to use fair and honourable means and to avoid unfair practices and fomenting litigation.
And the consequences in this particular matter were serious.
The High Court directed that the record be sent to the Bar Council of Delhi for consideration of disciplinary proceedings under Section 35 of the Advocates Act, 1961. It also directed registration of a suo motu criminal contempt proceeding and restrained the advocate concerned from representing the petitioner in the connected proceedings pending the further process.
The petitioner was additionally directed to pay ₹2 lakh in costs, divided between two specified organisations.

You may be dealing with CAW CELL DELHI, CAW Cell Nanakpura, Crime (Women) Cell, 498A/406 allegations, DV proceedings or a matrimonial FIR.
Your lawyer tells you:
“अब High Court में fresh petition डालेंगे.”
Before you celebrate a “new legal solution”, one basic exercise matters:
पूरी litigation history check हुई है या नहीं?
Previous quashing petition?
Revision?
Dismissal?
Withdrawal?
Earlier High Court order?
Supreme Court proceeding?
Same relief under another provision?
Any adverse order?
Any undertaking or settlement?
कुछ छूट गया तो?
A fresh filing does not automatically erase the old record.
And once a Court discovers that a material earlier proceeding was not disclosed, the focus may shift away from the original matrimonial grievance and towards how the Court was approached.
यही वह जगह है जहाँ आपकी case strategy, money, time और reputation पर unnecessary pressure बढ़ सकता है.
So don't merely ask your Advocate:
“Petition file हो गई?”
Ask something more important:
“Complete litigation history verify हुई है?”
“Previous orders annex किए हैं?”
“Earlier petitions और revisions disclose किए हैं?”
“Non-filing declaration किस basis पर दी जा रही है?”
“Court को पूरी procedural history दिखाई गई है?”
Because a lawyer's job is not simply to put your version on paper.
The Delhi High Court expressly emphasised the advocate's duty to assist the Court fairly and to verify material facts from the record.
And this is why I keep saying:
Case सिर्फ कहानी नहीं है.
Case record है.
Case history है.
Case orders हैं.
Case strategy है.
If you discover that something important was omitted, don't panic — but don't ignore it either.
First reconstruct the record.
Then identify exactly what was filed.
Then identify what was omitted.
Then examine what the Court has already ordered.
Then decide the next lawful step.

What was filed?
What was not filed?
What was disclosed?
What was overlooked?
What remedy is still legally available?
These questions can matter when your career, finances, family relationships and reputation are already under pressure from matrimonial litigation.
