MenCell.Org Delhi: Parents की Property में Wife का Residence Right? Delhi Court ने Alternate Accommodation का रास्ता बताया
अगर आपकी Delhi matrimonial dispute में सबसे बड़ा डर FIR या maintenance नहीं, बल्कि यह है कि wife आपके elderly parents के घर में रहने के right का claim कर रही है, तो इस issue को हल्के में मत लीजिए।
क्योंकि यहां सिर्फ husband और wife का dispute नहीं रहता।
एक तरफ wife का right to residence है।
दूसरी तरफ घर में रहने वाले senior citizen parents का peaceful life और property rights हैं।
और दोनों के बीच court को balance करना पड़ सकता है।
एक important Delhi District Court judgment dated 5 September 2026 — Shivani Verma v. Vedanta Verma & Ors. में यही complicated situation सामने आई।
पत्नी 2013 से Vasant Vihar स्थित matrimonial home में रह रही थी। बाद में matrimonial dispute हुआ और husband तथा wife उसी property के अलग-अलग portions में रहने लगे।
लेकिन husband के parents ने, जो senior citizens थे, Maintenance and Welfare of Parents and Senior Citizens Act, 2007 के तहत daughter-in-law और son को property से vacate कराने की proceedings शुरू कीं।
District Magistrate ने eviction order भी pass किया।
उधर wife ने Protection of Women from Domestic Violence Act, 2005 के तहत shared household में residence protection मांगी।
यानी एक ही घर के सामने दो अलग legal protections आ गईं।
Senior Citizens Act versus Domestic Violence Act.
और यहीं मामला complicated हो जाता है।
Court ने कहा कि DV Act के तहत woman's residence right को simply ignore नहीं किया जा सकता। लेकिन यह right automatically यह भी नहीं बन जाता कि वह उसी property में permanently रहने का indefeasible right हासिल कर ले।
Court ने Supreme Court के principles का reference देते हुए समझाया कि senior citizens को भी अपने घर में peace and dignity के साथ रहने का अधिकार है और competing rights को balance करना होगा।
इस particular case में Court ने एक practical solution अपनाया।
पत्नी को अचानक homeless नहीं किया गया।
लेकिन उसे उसी house में indefinitely रहने का absolute right भी नहीं दिया गया।
Court ने कहा कि उसका residence right Section 19(1)(f) DV Act के तहत alternate accommodation देकर secure किया जा सकता है।
इसलिए Trial Court को comparable accommodation के लिए rent determine करने का direction दिया गया। Judgment में यह भी record हुआ कि husband ने alternate accommodation के लिए ₹2 lakh per month rent देने की willingness बताई थी।
Court ने कहा कि existing premises खाली कराने से पहले alternate accommodation वास्तव में secure होना चाहिए।
अब अगर आप Delhi husband, Delhi matrimonial property dispute, senior citizen parents property, daughter-in-law residence rights, या DV Act shared household जैसी situation face कर रहे हैं, तो एक बात समझना बहुत जरूरी है:
“घर मेरे parents के नाम है, इसलिए wife को कोई right नहीं है” — यह अपने-आप complete legal answer नहीं है।
लेकिन इसका उल्टा भी सही नहीं है:
“यह shared household है, इसलिए wife हमेशा इसी property में रहेगी” — यह भी automatic rule नहीं है।
Facts, ownership, residence history, senior-citizen status, matrimonial circumstances और available alternative accommodation—सब matter कर सकते हैं।
इसलिए अगर आपके parents की property में matrimonial dispute चल रहा है और wife residence claim, DV proceedings और senior citizen eviction proceedings एक साथ चल रही हैं, तो अलग-अलग cases को isolated तरीके से देखना dangerous हो सकता है।
एक proceeding में लिया गया step दूसरी proceeding पर असर डाल सकता है।
और अगर parents genuinely senior citizens हैं, तो उनकी peaceful residence और dignity को लेकर available legal remedies को भी properly examine करना चाहिए।

Case-specific caution: This judgment did not hold that every daughter-in-law must leave a senior citizen's property, nor that every senior citizen can automatically evict a daughter-in-law through the Senior Citizens Act. The Court dealt with the particular competing residence and senior-citizen circumstances before it and protected the woman's residence through alternate accommodation. The result in another case can depend substantially on ownership, residence history, allegations, proceedings already pending and the accommodation actually available.
