Men Cell Delhi: Advocate की Double-Side Dealing — Client की confidential बात दूसरी तरफ कैसे पहुँच गई?
आपने अपने Advocate को सब कुछ बताया।
घर की पूरी कहानी।
Marriage की problems।
Property की details।
Bank transactions।
Messages और documents।
कौन-सी बात आपके खिलाफ जा सकती है और कौन-सी बात आपके favour में है — सब कुछ।
क्योंकि आपको लगा:
“यह मेरा Advocate है. इसे सब बताना जरूरी है.”
लेकिन कुछ समय बाद आपको पता चलता है कि वही Advocate किसी related dispute में दूसरी side के साथ दिखाई दे रहा है।
या फिर पता चलता है कि उसने पहले opposite party को represent किया था।
या किसी ऐसे matter में उसका connection है जिसमें आपके खिलाफ मौजूद confidential information उसके पास पहले से थी।
तब सवाल सिर्फ “Advocate किसके लिए appear कर रहा है?” नहीं रहता।
सवाल बन जाता है:
“मेरी confidential information का क्या हुआ?”
यही जगह है जहाँ conflict of interest का issue गंभीर हो सकता है।
लेकिन एक important बात समझना जरूरी है।
हर situation जिसमें Advocate दोनों parties को किसी न किसी समय जानता हो, automatically professional misconduct नहीं बन जाती। Supreme Court ने भी स्पष्ट किया है कि conflict of interest या professional misconduct का determination facts पर depend करता है और उसे competent authority के सामने establish करना पड़ता है।
इसलिए Client को emotion में आकर सीधे किसी Advocate पर corruption का आरोप लगाने के बजाय पहले facts collect करने चाहिए।
मसलन:
क्या Advocate ने पहले opposite party को represent किया था?
क्या दोनों matters आपस में substantially connected हैं?
क्या आपके पुराने case में आपने confidential information दी थी?
क्या वही information अब दूसरे पक्ष के काम आ सकती है?
क्या Advocate ने conflict disclose किया था?
क्या आपने written objection दिया था?
क्या दूसरे matter की pleadings या documents में आपकी confidential information दिखाई देती है?
इन सवालों के जवाब बहुत important हो सकते हैं।
खासकर matrimonial disputes में Client अपने Advocate को ऐसी बातें बता देता है जो उसने शायद किसी और व्यक्ति को कभी नहीं बताई होतीं।
Past relationship, family background, property details, bank information, private communications, settlement discussions, personal weaknesses, documents — सब कुछ।
इसलिए lawyer-client relationship केवल “fees देकर service लेने” जैसा simple commercial transaction नहीं है।
Supreme Court ने professional ethics के संदर्भ में कहा है कि Advocate और client के बीच confidence और trust महत्वपूर्ण हैं और professional conduct में client के हित तथा good faith की अपेक्षा रहती है।
और अगर आपको genuinely लगता है कि आपके Advocate का conflict of interest हो सकता है, तो सबसे पहले अपनी पुरानी file, vakalatnama, pleadings, emails, WhatsApp messages और previous case history सुरक्षित करिए।
फिर यह देखिए कि दूसरी side वाले matter में वास्तव में Advocate की भूमिका क्या है।
क्योंकि केवल यह सुन लेना कि:
“वह Advocate पहले उन्हें जानता था”
अपने-आप में misconduct साबित नहीं करता।
लेकिन अगर facts दिखाते हैं कि Advocate ने एक client से confidential information प्राप्त की और बाद में उसी या materially connected dispute में opposite interest के साथ काम किया, तो situation को गंभीरता से examine करना चाहिए।
Delhi में divorce lawyers, matrimonial advocates और family-law professionals की तलाश करने वाले husbands के लिए यह एक बात हमेशा याद रखने लायक है:
अपने Advocate को information देना जरूरी है — लेकिन अपने case की file और communication का independent record रखना भी जरूरी है।
आपका पूरा case केवल किसी एक व्यक्ति की memory पर dependent नहीं होना चाहिए।
अगर आपको शक है कि आपके Advocate ने आपके खिलाफ खड़ी दूसरी side से professional connection, previous representation या conflict of interest छिपाया है, तो अगली hearing तक चुपचाप wait मत कीजिए।
पहले facts निकालिए।
Documents सुरक्षित करिए।
Court record check करिए।
और फिर situation की proper legal review कराइए।
क्योंकि अगर confidential information गलत जगह पहुँच गई, तो बाद में यह पूछना कि “उसे पहले क्यों नहीं रोका?” बहुत देर से पूछा गया सवाल हो सकता है।

अगर आपको लगता है कि आपके Advocate का interest आपके interest से अलग दिशा में जा रहा है, तो इसे केवल “शायद कुछ नहीं होगा” कहकर ignore मत कीजिए। पहले facts verify करिए — क्योंकि confidential information एक बार बाहर चली जाए तो उसे वापस लाना आसान नहीं होता।
