Sometimes the most painful part of a matrimonial dispute is not the FIR.

It is not being able to see your own child.

A father may be living in Delhi while the child is somewhere else. Calls stop. Visits get cancelled. फिर धीरे-धीरे एक पिता को लगने लगता है कि शायद वह अपने बच्चे की life से ही बाहर होता जा रहा है.

But a matrimonial dispute does not automatically erase a father's relationship with his child.

A 15 April 2026 Delhi High Court order in Harsh Vardhan Singh v. Parameeta Singh dealt with exactly this kind of practical problem.

The Family Court at Saket, New Delhi had earlier directed that the father would meet his approximately three-year-old child on the third Saturday of every month, under supervision, and would also have a weekly video call with the child.

The problem was that the mother had shifted to Arunachal Pradesh.

The father alleged that this made it extremely difficult for him to exercise the visitation arrangement and that the relocation had effectively made the existing Delhi-based arrangement difficult to follow.

The matter reached the Delhi High Court.

Instead of treating the father's request as merely a fight between two adults, the Court referred back to the central principle in child-custody matters:

the welfare of the child is paramount.

The High Court directed that visitation should take place in Delhi on the first Saturday of May at the Delhi High Court Mediation and Conciliation Centre. The mother was directed to travel to Delhi with the child, while the father was directed to reimburse the expenditure incurred for that travel. The child's grandfather was also permitted to remain present during the visitation. The Court further directed that video interaction should continue.

This is a very different issue from CAW Cell Delhi or a matrimonial FIR.

It is about something fathers frequently search for in desperation:

“Wife is not allowing me to meet my child — what can I do?”

“Can mother shift the child to another State?”

“Father visitation rights Delhi Family Court.”

“Mother not following child visitation order.”

And sometimes:

“498A case चल रहा है, क्या मैं अपने बच्चे से मिल सकता हूँ?”

These are not questions that should be answered merely by saying, “Talk to your wife.”

If there is already a Family Court order, preserve the order, the dates of missed visits, WhatsApp communications, emails, video-call records and any documented reason given for cancellation.

Don't create confrontations.

Don't arrive at someone's house and try to force access.

Don't take the child yourself.

Instead, build a lawful record of non-compliance and use the appropriate court process.

For a father dealing simultaneously with CAW Cell Delhi, CAW Cell Nanakpura, Crime (Women) Cell, DV proceedings, divorce proceedings or a Delhi NCR matrimonial dispute, child-access issues should not be treated as an afterthought.

Because years later, the question may not simply be who filed what complaint.

It may be:

“How much contact did the father actually have with his child during those years?”

और अगर child छोटा है, तो time itself becomes important. A missed month is not always just a missed date — the child is growing during that month.

So if a visitation order already exists and it is repeatedly not being followed, don't simply keep waiting and hoping that the situation will correct itself.

Get the order, chronology and actual communication record examined before the situation becomes even more difficult.

Case-specific caution: The Harsh Vardhan Singh order concerned its own child, existing visitation directions, the parents' circumstances and the particular relocation issue before the Delhi High Court. It does not mean that every father is automatically entitled to the same visitation arrangement or that every relocation by a parent will be treated in the same manner. In custody and visitation disputes, the child's welfare and the specific facts and existing court orders remain central.
