Subject: Seeking certified information under RTI Act, 2005 regarding false allegations of POCSO/molestation filed by tenant’s wife against me and my family members to extort money and avoid eviction.

Background:
I, Mr. Sandeep Mehra, rented a portion of my house to Mr. Arvind Gupta and his wife Mrs. Nisha Gupta in July 2023. After disputes regarding rent arrears and misuse of premises, I asked them to vacate. To avoid eviction, Mrs. Nisha Gupta filed false allegations of molestation against me, my younger brother, and even included my 70-year-old father. She went further and manipulated her minor son’s statements under POCSO provisions. The intention was clear: to harass us, extort money, and continue illegal possession of my property. Despite my complaints, the police acted in collusion with them. I therefore seek the following information under RTI Act, 2005.

Information Sought:

  1. Certified copy of FIR registered at PS Lajpat Nagar on complaint of Mrs. Nisha Gupta under POCSO Act and IPC 354/376 sections (if any).
  2. Certified copy of DD entry of complaint lodged on 20.06.2025 by Mrs. Gupta.
  3. Certified copy of statements recorded under Section 161 CrPC of alleged victim (minor son).
  4. Certified copy of statement under Section 164 CrPC recorded before Magistrate.
  5. Certified copy of guidelines followed by IO before recording child’s statement.
  6. Certified copy of presence/absence of Child Welfare Committee representative during statement.
