Your Indian matrimonial dispute is pending.
You have travelled to India before without any problem.
So you assume:
“There is no issue with my passport. I can fly back whenever I need.”
But what if an LOC — Look Out Circular — is already operating against you?
And what if you discover the problem only when you are trying to leave India?
A recent Delhi High Court order dated 2 September 2026 gives NRI litigants an important procedural warning.
In Sanjay Dangi v. Union of India & Ors. & connected matters, the Court dealt with pleas concerning LOCs and requests for temporary suspension so that the petitioners could travel abroad.
The Court observed that such a request for temporary suspension of an LOC for foreign travel should, in the first instance, be made before the competent Special Court seized of the prosecution complaint.
Read that carefully.
An NRI husband may think:
“I will challenge the LOC in the High Court.”
But when an urgent overseas journey becomes necessary, the question can become:
Which Court should I approach first for temporary travel relief?
That is not a question you want to discover at the airport.
Think about the practical consequences.
You have:
job abroad
visa conditions
employer commitments
family responsibilities
flight tickets
foreign residence
immigration obligations
And suddenly:
“You cannot leave.”

किस authority ने request भेजी?
क्या कोई pending criminal proceeding है?
क्या Court appearance, bail, investigation या other conditions are involved?
क्या your Indian advocate actually checked your travel status?
This is why an NRI husband should not treat matrimonial litigation as something that can simply be left with an advocate while he remains abroad.
Notice आया? Read it.
Summons आया? Understand it.
Criminal case registered? Check it.
Court order passed? Obtain the complete order.
Travel planned? Check the consequences before booking the flight.
And never assume:
“मेरे खिलाफ कोई warrant नहीं है, इसलिए airport पर कोई problem नहीं होगी.”
An LOC is a different procedural issue.
The frightening part is not merely being stopped.
The frightening part is discovering the problem when you are already standing at the immigration counter.
